NAP’s parent company is Yoox Net-A-Porter Group S.p.A.,  a company fully owned by LuxExperience B.V., with registered office at via Morimondo n. 17 - 20143 Milan, Italy. The Operator is responsible for the implementation of the rules and regulations in accordance with applicable legislation.

"Personal data": any information referring directly or indirectly to a data subject.

"Processing": any activity that involves the use of personal data. It includes obtaining, recording or holding the data, or carrying out any operation or set of operations on the data including organizing, amending, retrieving, using, disclosing, erasing or destroying.

2. What personal data do we process, for which purpose and what is the lawful basis for processing it?

We collect data from you when you visit our website or while using our associated app. The data we collect includes your name, email address, telephone number and shipping/billing address, your day and month of birth, your favourite designers and information regarding your browsing and shopping behaviour. Data is collected when you place an order, call our Customer Care team, register with us, opt-in to our marketing communications, browse our website and use other services offered by our website. The data we collect are used to take your order, process payment and deliver your purchase to you. We also use it to deliver marketing communications, give access to services for registered users, personalise your visit to our website and provide assistance via our Customer Care team.

We collect your personal data only when there is a specific stated purpose for the processing. We use your personal data on the following grounds: performance of a contract, consent which you provide to us, a legal obligation we are required to follow and legitimate rights and interests of the Operator.

i.Contract

• Purpose: When you purchase a product from our website or app we ask you for the personal data necessary to allow us to fulfil our contract with you including despatching your item and taking payment from you. Some of your personal data will also be used to manage your requests for customer service.

• Purpose: When you register on the website or download the app we process your data necessary to allow you to benefit from services reserved to registered users.

• Purpose: When we have a service message we need to send you via email confirming your order or returns or informing you of any changes that might affect your order, our service to you or changes to our legal terms and conditions

• Purpose: If you are a member of a reward programme with one of our partners, your personal data will be used to fulfil your reward including despatching your item, taking payment from you and managing your requests for customer service

Personal Data Processed: Contact details (name, address, postcode, phone number), financial details (credit and debit card details etc), reward value, partner programme, delivery address.

• Purpose: When you sign up to our Recommend a Friend scheme following a friend’s referral.

Personal Data Processed: Name, email address and order ID

• Purpose: When you have referred a friend to get validation of the referral and the referral reward.

Personal Data Processed: Name and email address.

ii. Consent

• Purpose: For direct marketing by email and, from time to time, telephone, SMS or WhatsApp along with the use of tracking technologies to make sure the message has been delivered, that you have opened it and to monitor if you have clicked on any of the links.

Personal Data Processed: Name, email address, browsing and purchase history, engagement with email and its content, date of consent.

• Purpose: Push notifications via our website and app to offer goods and services that may be relevant to you. These can be configured in the settings of your device or browser.

Personal Data Processed: Products viewed, placed in cart or purchased, name, date of birth, gender, language used to navigate and version of your use (country), device (ID or IP address) and browser information; date and time when you provided consent to receiving web push notifications; date of creation of the account; date of last visit to our website or app.

• Purpose: When you receive email marketing communications from us after entering a competition run by one of our affiliate partners.

Personal Data Processed: Name and email address.

• Purpose: If you have consented to receive email communications, we may supply your email address to social media or digital advertising companies who work on our behalf, such as Facebook to show you advertising via these sites that is tailored to your interests and your purchase history.

• Purpose: When we contact our customers to invite them to participate in our_ customer satisfaction/market research surveys in order to improve the quality of our products and services._

iii. Legal Obligation

• Purpose: When you make a purchase on our website and app, we are required to process your personal data to meet our legal obligations in accordance with the tax provisions and other statutory rules which apply.

• Purpose: When we process your information in response to you exercising your data subject rights.

iv. Legitimate Rights and Interests of the Operator

• Purpose: When we have a service message we need to send you via email confirming your order or returns or informing you of any changes that might affect your order, our service to you or changes to terms and conditions.

Personal Data Processed: Name and email address.

• Purpose: Calls to our Customer Care team are recorded and live chat messages monitored to ensure a high level of customer service to our clients, to enable the development of staff training and to manage queries or complaints.

Personal Data Processed: Recordings of calls to our Customer Care team, live chat messages, customer name, account ID and order ID, the pages you have viewed and items in your Shopping Bag and any other contact details you might provide to us during the course of the conversation.

• Purpose: To offer an enhanced customer experience, provide products relevant for our customers and personalise our services and offers (including the marketing that individuals receive in our marketing messages or are shown on our own and other websites and apps, including social media), we need understand customers’ needs, the products and services that they are interested in. For this reason, we analyse shopping histories, browsing histories, customer demographics and market research information. In this way, we identify customers’ groups or segments who display similar behavioural patterns.

Personal Data Processed: E-mail address, Customer ID, browsing data, IP address, order history, products added to wish list or basket, age, gender, physical address, market research information such as attitudes to fashion, service needs and spend on designer clothing.

• Purpose: When you save an item to your Shopping Bag, but don’t check out, we’ll send you an email service message to remind you that you haven’t checked out

Personal Data Processed: Name, email address, item(s) saved in Bag.

• Purpose: When you make a purchase, we may request feedback on your buying experience, typically via pop up surveys or email.

Personal Data Processed: Name, email address, telephone number, products purchased, feedback comments.

• Purpose: When you make a purchase on any of our websites, we will use some of your personal data to prevent and control fraud by means provided by law.

Personal Data Processed: Name, billing and shipping address, email address, phone number, payment information, previous order history.

• Purpose: We may use your data to establish or exercise our legal rights or to defend against any legal claims.

Personal Data Processed: Identification data and other personal data that may be relevant to the specific legal claim.

3. Who will process your personal data?

Your personal data will be processed by the staff of the Operator, who have been specially trained and assigned with specific powers for data processing activities.

When necessary for the provision of services, the sale of products and other purposes specified in this Policy, your personal data may be provided and processed on our behalf by our counterparties (suppliers or commercial partners). These counterparties process data solely within the purposes of processing personal data stated in this Policy and on the basis of an agreement containing obligations to comply with personal data legislation and ensure the security of data during their processing.

The processing of personal data on behalf of the Operator is carried out, in particular, by:

• Data center - for the purposes related to the placement of servers on the territory of the Russian Federation;
• Bank and other payment service providers - for the purposes related to payment processing;
• Delivery service - for the purposes related to the shipment and delivery of the goods you purchased;
• Call-center – for the purposes related to the operation of the call-center and the Customer Care team.

Data may also be processed on behalf of the Operator by suppliers providing software, email delivery, marketing and market research services that help us carry out our business activities.

Personal data may also be provided to government and regulatory authorities if this is necessary to comply with our legal obligations. Furthermore, under an official request and in accordance with applicable law, personal data may be provided to law enforcement authorities (for instance, if the Operator is required to assist in the prevention of fraud when purchasing goods on www.theoutnet.com).

In carrying out the data processing for pre-contractual performance and fulfilment as well as for marketing measures, THE OUTNET, as a part of LuxExperience Group, will share your personal data with other affiliated entities of our parent company LuxExperience B.V. based on Art. 6 (1)(a) or (f) of the General Data Protection Regulation (Regulation (EU) 2016/679).

We may also provide your personal data to a buyer or potential buyer if our assets are acquired by another entity. In this case, this buyer will be obliged to use your personal data strictly in accordance with this Privacy Policy.

4. Cross-Border Transfer

Your personal data may not be transferred abroad to countries that are not parties to the Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data of Council of Europe of 1981 and or to countries that are not included in the list of the countries providing an adequate protection of personal data (this list is approved the competent authority for the protection of the rights of data subjects of the country of the data subject) without your prior consent. Cases where the above action is necessary for the performance of a contract with you may constitute an exception.

5. How long do we keep your personal data?

Unless otherwise provided under applicable laws, we keep your personal data only for the period necessary to achieve the purposes for which they were originally collected, or until you withdraw your consent.

In the event you withdraw your consent or, in any case, upon achieving the purpose for which personal data was collected, within a period not exceeding thirty days, if you have not requested the activation of additional services, the Operator ceases processing of personal data and ensure their destruction.

7. Your Rights

NAP complies with requests for access to personal data as established by applicable laws. The data subject is entitled to modify their own personal data by signing in to their account on the website. The data subject is able to delete saved credit/debit card details.

At all times the customer has the right to opt-out of subscribing to our regular service updates on new products, features, enhancements, special offers, upgrade opportunities, contests, events of interest, and one-off marketing promotions. Any electronic message sent by NAP contains an easy automated unsubscribe link. The customer can also change their email preferences or opt out of all emails by signing in to their account on the website.

We are committed to taking appropriate technical, physical and organisational measures to protect personal information against unauthorised access, unlawful processing, destruction, accidental loss or damage. In particular, we use security measures that employ pseudonymisation or encryption of your data to ensure the confidentiality, integrity, and availability of your data along with the resilience of the systems and services that process them. Operator ensures the ability to restore the availability and access to personal data in the event of a physical or technical incident. Furthermore, the Operator undertakes to test, verify and regularly evaluate the effectiveness of technical and organizational measures in order to ensure continuous improvement in the safety of processing.

9. Changes to the Privacy Policy

We keep our Privacy Policy under regular review in order to reflect changes in our services and in privacy regulation. We recommend that you regularly review this section of the website in order to have up-to-date information on the data processing rules. This Privacy Policy was last updated on 23rd April 2025.
